The short version

What applies here.

This page applies to the public HiGoTec website. The website is currently provided for general company information and does not sell products or accept payments.

Mission Control and any separately branded products or services will have their own terms and privacy information when those services become available. Those specific terms will apply in addition to this page.

Nothing in these terms removes any right or guarantee that cannot legally be excluded under the Australian Consumer Law or other applicable law.

Part one

Privacy Policy.

1. Who we are

HiGoTec Pty Ltd (HiGoTec, we, us or our) is an Australian technology company. This policy explains how we handle personal information connected with this public website.

2. Information collected through this website

The public website does not currently include a contact form, user registration, online purchasing or payment facilities.

When the website is visited, our web server can automatically record limited technical information such as an IP address, browser type, requested page, date and time, and security or error information. This information is used to operate, secure and diagnose the website.

If you contact us by post or otherwise deal with us directly, we may hold the information you provide, such as your name, contact details, correspondence and the reason for your enquiry.

3. Cookies

We do not intentionally use advertising or behavioural-tracking cookies on this public website. Essential session or security cookies may be used where required for the website or future secure access features to work properly.

4. How we use personal information

We use personal information only where reasonably needed to:

  • respond to an enquiry or request;
  • operate, maintain and protect the website;
  • detect misuse, security incidents or technical problems;
  • keep appropriate business and legal records; and
  • comply with applicable laws and lawful requests.

We do not sell personal information.

5. When information is shared

We may provide limited information to organisations that help us operate the website or business, such as website hosting, information technology, security, professional and records-management providers. They may use the information only for the work they perform for us or as the law otherwise permits.

We may also disclose information where required or authorised by law, or where reasonably necessary to prevent a serious threat, investigate suspected unlawful activity, or protect our legal rights.

6. Overseas disclosure

We do not ordinarily disclose personal information collected solely through this public website to overseas recipients. If a connected product or service uses overseas providers, its privacy notice will explain the likely locations where practicable before that information is collected.

7. Storage, security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps can include access controls, encryption, monitoring, backups and maintaining systems appropriate to the information involved.

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected, to resolve an issue, or to meet legal, accounting and record-keeping requirements. Information that is no longer required is destroyed or de-identified where practical and lawful.

8. Access and correction

You may ask whether we hold personal information about you, request access to it, or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We may need to verify your identity before acting on a request.

In limited circumstances the law allows us to refuse access. If that happens, we will explain the reason where we are legally able to do so.

9. Privacy complaints

If you believe we have mishandled your personal information, write to our Privacy Officer using the address below. Please explain the issue and provide enough information for us to investigate it. We will acknowledge and assess the complaint and aim to provide a response within 30 days.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at oaic.gov.au.

10. Connected services

Mission Control and other HiGoTec-operated products may collect account, transaction, content or service information that this public website does not collect. Before those features are made available, their specific privacy notices and terms will explain what is collected and how it is handled.

11. Policy updates

We will update this policy when our information-handling practices or legal obligations change. The current version and its update date will remain available on this page.

Part two

Website Terms.

1. Agreement to these terms

By using this website, you agree to these Website Terms. If you do not agree, please stop using the website. These terms apply only to this public website.

2. General information

The website provides general information about HiGoTec. It is not professional, legal, financial or technical advice and should not be relied on as a substitute for advice suited to your circumstances.

We take reasonable care with website content, but information can become incomplete or out of date. Contact us before acting on information where accuracy is important to your decision.

3. Acceptable use

You may use the website for lawful purposes. You must not:

  • attempt to gain unauthorised access to the website, server, accounts or connected systems;
  • introduce malicious code, overload the website, probe security or interfere with normal operation;
  • use automated tools to copy substantial parts of the website without permission;
  • impersonate another person or misrepresent your connection with HiGoTec; or
  • use website content in a way that infringes another person’s rights or breaks the law.

We may take reasonable steps to protect the website, including restricting access linked to suspected misuse or security threats.

4. Intellectual property

Unless stated otherwise, HiGoTec or its licensors own the website, branding, design, text, graphics, software and other content. You may view the website and keep a reasonable personal copy for reference.

You must not reproduce, modify, publish, distribute, sell, license or commercially exploit substantial website content without prior written permission, except where Australian law permits that use.

5. Trade marks

HiGoTec names, logos and related branding are trade marks or other protected brand assets. Use of the website does not grant permission to use them in a business name, domain name, product, advertising or any way that suggests endorsement or association.

6. Links and separately operated services

The website may link to other websites or services. A link is provided for convenience and does not automatically mean we endorse all content on the linked site. We are not responsible for a third-party website that we do not control.

Mission Control and separately branded products or services may have additional terms, privacy notices, pricing and eligibility rules. If there is an inconsistency, the specific terms for that service apply to its use or purchase, while these terms continue to apply to this public website.

7. Website availability and security

We aim to keep the website available and secure, but uninterrupted or error-free access cannot be guaranteed. Maintenance, faults, internet conditions, security events or circumstances outside our reasonable control may affect availability.

You are responsible for using suitable security precautions on your own device and internet connection.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or other applicable law.

Any terms applying to a paid HiGoTec product or service will be provided at the relevant point of registration or purchase. Those terms will not remove rights that the law says cannot be removed.

9. Responsibility for loss

To the extent permitted by law, HiGoTec is not responsible for loss caused solely by reliance on general website information, temporary unavailability, unauthorised third-party activity that we could not reasonably prevent, or content on a website we do not control.

This limitation does not apply where loss results from our fraud, wilful misconduct, negligence, breach of an applicable consumer guarantee, or where liability cannot legally be limited or excluded.

10. Changes to the website or these terms

We may change the website as our business develops. We may also update these terms to reflect changes to the website, our practices or the law. Updated terms apply from the date shown on this page and do not retrospectively change an existing separate agreement.

11. Governing law

These terms are governed by the laws of Queensland, Australia. The courts of Queensland and courts entitled to hear appeals from them have jurisdiction, subject to any rights you have to bring a matter elsewhere under applicable law.
